Main information about the service
For equipment or protective systems intended for use in potentially explosive atmospheres, or for safety, control and regulating equipment intended for use outside potentially explosive atmospheres but which is necessary for - or contributes to - the safe operation of the products mentioned above, the Office for Standards, Metrology and Testing may, if in the interest of safety and in justified cases, permit their placing on the market or putting into service in the Czech Republic without the conformity assessment otherwise required for placing on the market or putting into service (Section 48c of Act No 90/2016, on the conformity assessment of specified products when placed on the market).

The Office for Standards, Metrology and Testing issues permits through an administrative procedure. In such a case, the procedure will be conducted in accordance with the Administrative Procedure Code. The administrative procedure begins with the submission of a complete application The Administrative Procedure Code sets a deadline of 30 days for the processing of an application.

What do you need when solving the service electronically
To obtain a permit, you need to deliver a reasoned application that must have the requisites specified in Section 45(1) of the Administrative Procedure Code. The application may be written in free form.

If a permit is not granted by the authority for the said equipment, the requirements in Act No 90/2016 and the relevant government decree on its implementation will apply for the placing on the market or putting into service of such equipment. If such equipment is placed on the market or put into service without these requirements being met, the Czech Trade Inspection Authority, as the supervisory body, may proceed in accordance with Section 49 of Act No 90/2016.
