The purchase, offer to purchase, acquisition for commercial purposes, public display for commercial purposes, exploitation for commercial gain and sale, possession for sale, offer for sale or transport for sale of specimens of endangered species listed in Annex A to Council Regulation (EC) No 338/97 is prohibited.
If you intend to commercially handle specimens of endangered species listed in Annex A to Council Regulation (EC) No 338/97 within the European Union, you need a certificate of exemption from the ban on commercial activities.
A certificate of exemption from the ban on commercial activities can be issued by the locally competent regional authority, in the case of Prague, the Prague City Hall.

Back to topIf you are planning any commercial use of a specimen of an endangered species listed in Annex A to Council Regulation (EC) No 338/97 involving public display for commercial purposes, use for commercial gain and sale, possession for sale, offer for sale or transport for sale, you must arrange in advance for a certificate of exemption from the ban on commercial activities on the basis of an application to the locally competent regional authority; in the case of Prague, to the Prague City Hall.
How to get the service
What do you need when solving the service electronically
An application for a certificate of exemption from the ban on commercial activities must include:
• a completed Application form - see the online application form;
• proof of origin of the specimen (e.g. import permit from a third country);
• theregistration certificate for compulsorily registered specimens, unless the first registration of the specimen is applied for at the same time;
• proof of permission to keep, breed in captivity or cultivate a specimen that is a specially protected species pursuant to Act No 114/1992 Coll. or a bird of a species that lives freely in the territory of the Member States of the European Union;
The application must also be accompanied by proof of payment of the administrative fee paid in accordance with item 61(1)(h) and (i) of the ‘Tariff’ to Act No 634/2004 Coll., on Administrative Fees, or a request for exemption from this fee with justification in accordance with item 61 of the ‘Tariff’.
Where and how to solve the service electronically
Fill in theapplication and send it together with all attachments to thelocally competent regional office or, in the case of Prague, to the Prague City Hall either:

- or by email to the filing office of the competent authority. The email application must be signed electronically.
In the case of natural persons not engaged in business, local jurisdiction is determined by the place of permanent residence, in the case of natural persons engaged in business by the place of business. In the case of legal persons, local jurisdiction is determined by the place of the registered office or the place of the registered office of the organisational unit.
Applications are dealt with in an administrative procedure and a decision is issued within 30 days from initiation of the procedure. (The procedure shall be initiated on the date of receipt of the application.)

The fee for electronically processed service
You must pay a fee of CZK 100 for each copy of the application for a certificate of exemption from the ban on commercial activities, if you are applying for a certificate for 1 to 20 specimens of a species of wild fauna or flora.
If you apply for a certificate of exemption from the ban on commercial activities for more than 20 CITES specimens, you must pay a fee of CZK 2 000.
These fees are levied in accordance with item 61(1)(h) and (i) of the ‘Tariff’ to Act No 634/2004 Coll., on Administrative Fees.
The issuing office will only accept applications accompanied by a receipt for payment of this fee, except if you apply in writing for an exemption from the fee, stating your reasons under item 61 of the ‘Tariff’.
Exemption
The receipt of an application for the issuance of an exemption from the ban on commercial activities for specimens intended for rescue breeding or for scientific or educational purposes, for specimens intended for breeding or cultivation purposes within the framework of a rescue programme and for specimens originating from or intended for breeding or for the collections of zoological and botanical gardens, departments of universities, the Academy of Sciences of Czechia and other scientific departments registered by the Ministry of the Environment shall be exempt from the fee under item 61(1)(h) and (i).
